What changes on 29 October 2026?

Trading Standards officers have strengthened powers from this date to inspect premises, issue fines and remove stock.

Why is the law changing now?

Until October 2026, nicotine pouches occupied an unusual position in UK law. They contain nicotine but no tobacco leaf, so they fell outside both tobacco and vaping legislation. General product safety rules covered them instead—general consumer safety and labelling rules, with no legal minimum age of sale at all.

That meant pouches could legally be sold to children, which was never the intention. Responsible retailers had operated on a voluntary 18+ basis for years, but there was no legal backing for it.

What is not changing?

Several points are worth stating clearly, because there's been confusion in coverage of the Act.

Nicotine pouches aren't being banned. They remain legal to buy, sell and use for adults aged 18 and over.

Flavours aren't being restricted. The Act gives the Government powers to regulate flavours, packaging and display, but a power isn't a rule. There's no strength cap. There's currently no general statutory UK maximum nicotine strength per pouch. CLEW offers 5mg to 20mg, with 20mg being the highest in the CLEW UK range. That's a brand specification, not a legal ceiling. The Act allows the Government to set product requirements in future, but any such limit would need its own commencement date.

What comes after October 2026?

 The advertising ban in June 2027 is the more significant of these for the category. Restrictions on packaging, flavours and strength are possibilities the Act enables rather than commitments it makes.

What should buyers do?

Nothing urgent. If you're over 18 and buying from a retailer that verifies age, you're already compliant with what arrives in October. Two practical points are worth noting.

• Keep ID accessible if buying in person. Shops will apply Challenge 25 more consistently from October, so expect to be asked more often than you have been.
• Expect the online age check to stay in place. It isn't new, and it won't be removed.
